4.2 Factors for Consideration
Factors for Consideration (California Government Code §56668)
- Population and population density; land area and land use; assessed valuation; topography, natural boundaries, and drainage basins; proximity to other populated areas; the likelihood of significant growth in the area, and in adjacent incorporated and unincorporated areas, during the next 10 years.
The territory for which a change of service provider is proposed – from the Roseland Fire Protection District (Roseland FPD) to the Rincon Valley Fire Protection District (Rincon Valley FPD) - is primarily residential with some large parcels to the far southwest used for agricultural purposes. Several hundred people reside there. An area along State Highway 12 has commercial uses. All the territory is unincorporated, with one area and the easterly portion of the second, more western-located “island” located within the sphere of influence of the City of Santa Rosa.
No change is proposed in the land area where fire and emergency services would be provided. This is an interim step as part of a larger proposed reorganization for fire services. - Need for organized community services; the present cost and adequacy of governmental services and controls in the area; probable future needs for those services and controls; probable effect of the proposed incorporation, formation, annexation, or exclusion and of alternative courses of action on the cost and adequacy of services and controls in the area and adjacent areas.
"Services," as used in this subdivision, refers to governmental services whether or not the services are services that would be provided by local agencies subject to this division, and includes the public facilities necessary to provide those services.
When five unincorporated islands of territory in southwest Santa Rosa were annexed to the City in 2017, much of the area within the Roseland FPD became part of the City. The District does not have the financial or service capability to provide efficient and effective fire and emergency services to two islands of territory of the District that remain (Remainder Areas). The Rincon Valley FPD surrounds these areas and can provide service. That District would receive a share of the property tax increment previously allocated to Roseland FPD, and a tax previously authorized by the district would be extended to the annexed parcels. In that the bulk of District territory is now part of the City, the District has requested that its assets be transferred to the City. - The effect of the proposed action and of alternative actions, on adjacent areas, on mutual social and economic interests, and on the local governmental structure of the county.
In that the Roseland FPD has determined that it does not have the financial or service capability to serve the Remainder Areas, with the large part of its territory now within the City, responsibility for provision of service should shift to another provider. Rincon Valley FPD is adjacent to the Remainder Areas. They are eligible for annexation to Rincon Valley FPD subject to LAFCO’s amendment of that district’s sphere of influence first. - The conformity of both the proposal and its anticipated effects with both the adopted commission policies on providing planned, orderly, efficient patterns of urban development, and the policies and priorities set forth in Section 56377. (Note: Section 56377 encourages preservation of agricultural and open-space lands.)
The proposal is consistent with Commission policies. In that the Roseland FPD has determined that it has neither the financial nor service capability of providing services to the Remainder Areas and another service provider is adjacent and can serve, dissolution of the Roseland FPD is a logical step. An orderly transition of service provision to Rincon Valley FPD and, subsequently, to Windsor FPD, if the Commission approves, will support planned and orderly governance. The largest portion of the Roseland FPD is now part of the City as a result of the Roseland Area Annexation in 2017. - The effect of the proposal on maintaining the physical and economic integrity of agricultural lands, as defined by Section 56016.
Not applicable. - The definiteness and certainty of the boundaries of the territory, the nonconformance of proposed boundaries with lines of assessment or ownership, the creation of islands or corridors of unincorporated territory, and other similar matters affecting the proposed boundaries.
The Remainder Areas are identifiable islands of territory whose boundaries are definite and certain. - A regional transportation plan adopted pursuant to Section 65080.
Not applicable. - The proposal’s consistency with city or county general plans.
The subject reorganization does not involve city or county general plans. In that the Roseland FPD has determined that it cannot efficiently and effectively serve the Remainder Areas and an adjacent service provider is available, dissolution of the district and annexation of its territory to Rincon Valley FPD is logical. - The sphere of influence of any local agency that may be applicable to the proposal being reviewed.
Much of the territory that had been in the Roseland FPD is now part of the City of Santa Rosa, as a result of the Roseland Area Annexation in 2017. Upon Commission action, the Remainder Areas will be within the sphere of influence of the Rincon Valley FPD, prior to consideration of annexation. - The comments of any affected local agency or other public agency.
The Roseland FPD has initiated the subject reorganization. No other comments have been received. - The ability of the newly formed or receiving entity to provide the services which are the subject of the application to the area, including the sufficiency of revenues for those services following the proposed boundary change.
As proposed, the Rincon Valley FPD will serve the Remainder Areas, upon dissolution of the Roseland FPD and annexation of that territory. The Rincon Valley FPD will receive that portion of the property tax increment previously allocated to Roseland FPD. In addition, a tax previously authorized by Rincon Valley FPD would be extended to the Remainder Areas. In that a large portion of the Roseland FPD is now in the City, the District has requested that its assets, including reserves, be transferred to the City upon dissolution of the District.
Annexation of the Remainder Areas to Rincon Valley FPD is proposed as an interim step in a larger reorganization of fire services with ultimate annexation of the Rincon Valley FPD territory to the Windsor FPD. - Timely availability of water supplies adequate for projected needs as specified in Section 65352.5.
Not applicable. - The extent to which the proposal will affect a city or cities and the county in achieving their respective fair shares of the regional housing needs as determined by the appropriate council of governments consistent with Article 10.6 (commencing with Section 65580) of Chapter 3 of Division 1 of Title 7.
Not applicable. - Any information or comments from the landowner or landowners, voters, or residents of the affected territory.
No comments from owners, voters or residents of the affected territory have been received. - Any information relating to existing land use designations.
Not applicable. - The extent to which the proposal will promote environmental justice. As used in the law, “environmental justice” means the fair treatment of people of all races, cultures, and incomes with respect to the location of public facilities and the provision of public services.
Not applicable. - Information contained in a local hazard mitigation plan, information contained in a safety element of a general plan, and any maps that identify land as a very high fire hazard zone pursuant to Section 51178 or maps that identify land determined to be in a state responsibility area pursuant to Section 4102 of the Public Resources Code, if it is determined that such information is relevant to the area that is the subject of the proposal.
Not applicable. No change in the level of fire services provided is anticipated.
