File No. 2019-08: Amendment of the Sphere of Influence of the Windsor Water District, Annexation of Assessor’s Parcel No. 059-310-051 to the Windsor Water District, and Windsor Reorganization No. 19-3 (South Shiloh Area) Involving Annexation to the Town of Windsor

NOTICE IS HEREBY GIVEN that the Sonoma Local Agency Formation Commission will conduct a public hearing at or after 2:00 p.m. on Wednesday, June 3, 2020, in the Sonoma County Administration Building, 575 Administration Drive, Room 102A, Santa Rosa, California, at which time all interested persons may be heard on the following item.  

File No. 2019-08: Amendment of the Sphere of Influence of the Windsor Water District, Annexation of Assessor’s Parcel No. 059-310-051 to the Windsor Water District, and Windsor Reorganization No. 19-3 (South Shiloh Area) Involving Annexation to the Town of Windsor.     

Depending on circumstances pursuant to the Governor’s Executive Orders N-25-20 and N-29-20, which suspend certain provisions of the Ralph M. Brown Act, and the directive of the Health Officer of the County of Sonoma to shelter in place due to the COVID-19 pandemic, the Commission may conduct this meeting entirely by teleconference. In such circumstances, no physical location for the meeting will be available, and members of the public will be unable to attend the meeting in person. Anyone wishing access to meeting information should consult the meeting agenda which will be posted on the Commission’s website at least 72 hours before the scheduled start time of the meeting.  

Lisa and Trini Amador initiated an application to annex Assessor’s Parcel Nos. 059-310-051 and 059-310-052 (affected territory) to the Town of Windsor to allow for future development of their properties at densities consistent with the land-use designations of the Town’s General Plan and to access Town services. Assessor’s Parcel No. 059-310-051 is outside the sphere of influence and boundary of the Windsor Water District, which is a subsidiary district of the Town but a separate legal entity. Pursuant to state law, territory must be within a district or city sphere of influence to be eligible for annexation to that district or city.  

The Sonoma Local Agency Formation Commission (LAFCO or Commission) will consider amendment of the sphere of influence of the Windsor Water District to include Assessor’s Parcel Number 059-310-051 at the public hearing and, following, will consider annexation of Assessor’s Parcel No. 059-310-051 to the Windsor Water District and annexation of the affected territory to the Town. Environmental Determination: Town of Windsor General Plan 2040 Program Environmental Impact Report and Environmental Checklist, pursuant to section 15168(c) of the California Environmental Quality Act Guidelines.  

At the hearing, the Commission will hear and receive any relevant oral and written testimony and evidence presented or filed regarding the proposed amendment to the Windsor Water District’s sphere of influence, annexation of Assessor’s Parcel No. 059-310-051 to the Windsor Water District, and annexation of the affected territory to the Town of Windsor and detachment from County Service Area No. 41 (Multi-Services). The Commission will consider the report of the Executive Officer, the plan for providing services, and the environmental determination for the proposal.  

Copies of documents or links to information relating to the application will be available for review on the Sonoma LAFCO website: www.sonomalafco.org on or after May 27, 2020. Should the hearing be conducted virtually, written comments must be received by Sonoma LAFCO by Wednesday, June 3, 2020, at 10:00 a.m. in order to be distributed to Commissioners. If you challenge the actions of the Sonoma Local Agency Formation Commission in court on the proposal, you may be limited to raising only those issues raised at the public hearing described in this notice or in written correspondence delivered to the Sonoma Local Agency Formation Commission prior to the hearing.  

ALL INTERESTED PERSONS ARE HEREBY INVITED TO BE PRESENT AND HEARD ON THE MATTERS DESCRIBED IN THIS NOTICE. SHOULD CIRCUMSTANCES DICTATE A VIRTUAL MEETING, THERE WILL BE NO PHYSICAL LOCATION FOR THE MEETING.
