Protest Hearing: File No. 15-07: Reclamation District No. 2061 Dissolution (Vallejo Sanitation and Flood Control District/Kenwood-BPSC Hunt Club, LLC)
The Vallejo Sanitation and Flood Control District and Kenwood-BPSC Hunt Club, LLC jointly initiated the proposal which involves dissolution of Reclamation District No. 2061. The District is comprised of 18 parcels encompassing approximately 2,750 acres. The District is generally located on the north and south sides of Highway 37, commonly known as Tubbs Island, bounded by Tolay Creek, East Branch of Tolay Creek, Sonoma Creek, and San Pablo Bay, in southeastern Sonoma County. The proposal is not a project subject to CEQA. If the proposal could be considered a project, it is exempt, pursuant to Sections 15301, 15325, and 15061(b)(3) of the State of California Environmental Quality Act Guidelines. The Commission approved the proposal on September 9, 2015, by Resolution No. 2649. A full and complete description of the proposal and the terms and conditions of the Commission’s approval are set forth in Resolution No. 2649. The reason for the proposal is to allow the two remaining property owners to continue maintenance and upkeep of all properties, activities which they have conducted since 1992; the District has no board of directors, no revenues or expenditures, no known financial obligations or liabilities, and serves no purpose.
The Commission will hear and consider any oral and written protests, objections, or evidence made, presented, or filed with the Commission. Any owner of land within the affected territory may file a written protest against the proposal with the Executive Officer of the Commission at any time prior to the conclusion of the public hearing described in this notice. Any owner of land who has filed a written protest may withdraw that protest at any time prior to the conclusion of the hearing described in this notice. Each written protest shall state the name and address of the owner of the land affected and the street address or other description sufficient to identify the location of the land. Protests may be made on behalf of an owner of land by an agent authorized in writing by the owner to act as agent with respect to that land. Protests may be made on behalf of a private corporation that is an owner of land by any officer or employee of the corporation without written authorization by the corporation to act as agent in making the protest. Each written protest shall show the date that each signature was affixed to the protest. All signatures without a date or bearing a date prior to the date of publication of this notice shall be disregarded for purposes of ascertaining the value of any written protests.
